<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">suffice it to say that the Gitmo Kangaroo Courts constitute war crimes under the<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Laws of War, the Four Geneva Conventions of 1949, and even the U. S. Army's own<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Field Manual 27-10, The Law of Land Warfare (1956). Field Manual 27-10 was<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">drafted for the Pentagon by my Laws of War teacher Richard R. Baxter, who was<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">generally recognized as the world's leading expert on that subject. That is<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">precisely why I voluntarily chose to study International Law with him and his<o:p></o:p></span></b></p>

<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">these five courts-martial under the U.C.M.J. were Stalinist show-trials produced<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">and directed by the Pentagon that predictably and readily degenerated into<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">travesties of justice. These five U.C.M.J. courts-martial involving U.S. warfare<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">each proved correct the old adage attributed to Groucho Marx that military<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">justice is to justice as military music is to music. By comparison, the Gitmo<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Kangaroo Courts will not even be run in accordance with the U.C.M.J. despite the<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">fact that the U.S. Supreme Court ruled in Hamdan that they should be. The Marx<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Brothers are running the Gitmo Kangaroo Courts.<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif"><o:p> </o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Whenever they are up and fully operating the Gitmo Courts will constitute<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Stalinist Show Trials as well as Kangaroo Courts, and their preliminary<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">proceedings have already proven them to be Travesties of Justice. Even worse<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">yet, fully-functioning Stalinist Gitmo Kangaroo Courts will quickly become<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">conveyor-belts of death for alleged and already tortured terrorist suspects<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">along the lines of the Texas execution chamber operated by George Bush Jr. when<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">he was the "governor" of that state and tortured to death 152 victims by means<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">of lethal injection. Gitmo and/or Gitmo-North in Illinois will become Americas<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">first-ever Nazi-style death camp.<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif"><o:p> </o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">But today under the Four Geneva Conventions of 1949, executing persons detained<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">as a result of armed conflict without a fair trial before a regularly<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">constituted court constitutes a grave war crime. To be sure, under the First<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Amendment to the United States Constitution Harvard Law Professor Vagts has the<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">freedom to advocate war crimes so long as he does not participate in their<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">commission, or incite them, or aid and abet them. But precisely where is that<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">line to be drawn for law professors?<o:p></o:p></span></b></p>

<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">In this regard, the Harvard Law School Faculty currently has at least five<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">professors who have advocated torture and war crimes:<o:p></o:p></span></b></p>

<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">1. Vagts himself, who supported abusing the then recently captured President of<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">Iraq Saddam Hussein despite his being publicly acknowledged to be a Prisoner of<o:p></o:p></span></b></p>
<p class="MsoNormal"><b><span style="font-size:16.0pt;font-family:"Arial Black",sans-serif">War by the Bush Jr. administration itself and thus absolutely protected by the<o:p></o:p></span></b></p>

Dear Members of the Harvard Law School Community,<br>

In view of Martha Minow's recent announcement of her plans to step down as dean of Harvard Law School at the end of the academic year after eight years of distinguished leadership, I write to launch the search for a new dean—and to invite your advice and counsel.<br>
<br>
At a time of extraordinary change in our nation and the wider world, Harvard Law School's core commitments—to excellence in legal education and scholarship, to the strengthening of legal systems and the legal profession, and to the advancement of justice for
all—matter as much as ever before. There is no law school whose faculty, students, staff, and alumni have greater capacity to fulfill the law's potential to shape our world for the better. Identifying an outstanding new dean to guide that collective effort
will be one of my foremost priorities in the months to come.<br>
<br>
In line with usual Harvard practice, I have invited a group of senior faculty members with varied perspectives and expertise to serve on an advisory committee that will help Provost Alan Garber and me with the search. They are listed at the end of this message.
I very much appreciate their willingness to focus on this important task.<br>
<br>
The advisory committee's work will be central to a wider outreach process to which I hope many of you will contribute. Provost Garber and I will be pursuing avenues to solicit perspectives and insights from the broader faculty, students, staff, alumni, and
others within and beyond Harvard. We will particularly appreciate input on the principal opportunities and challenges facing Harvard Law School in the years ahead, on the professional and personal attributes you regard as most important to seek in the next
dean, and on particular individuals at Harvard or elsewhere who you believe warrant serious consideration for the deanship.<br>
<br>
With this in mind, I hope that many of you will take the time to share your thoughts. You may write to me, in confidence, by email to
