<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">public international law to sit in judgment over a gross and consistent</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">pattern of violations of the most fundamental norms of international</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">criminal law committed by any member state of that same World Community.</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Such is the case for the International Tribunal of Indigenous Peoples and</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Oppressed Nationalities in the United States of America that convenes in San</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Francisco during the weekend of October 1-4, 1992. Its weighty but important</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">task is to examine the long history of international criminal activity that</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">has been perpetrated by the Federal Government of the United States of</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America against the Indigenous Peoples and Peoples of Color living in North</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America since it was founded in 1787.</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif"> </span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Toward that end, I have the honor to present to the Members of this Tribunal</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">the following charges against the Federal Government of the United States of</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America under international criminal law. In light of the gravity, severity,</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">and longstanding nature of these international crimes and also in light of</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">the fact that the Federal Government of the United States of America appears</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">to be irrevocably committed to continuing down this path of lawlessness and</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">criminality against Indigenous Peoples and Peoples of Color living in North</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America and elsewhere, I hereby petition the Members of this Tribunal to</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">issue an Order proscribing the Federal Government of the United States of</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America as an International Criminal Conspiracy and a Criminal Organization</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">under the Nuremberg Charter, Judgment, and Principles as well as the other</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">sources of public international law specified below. For that reason, I also</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">request that the Members of this Tribunal issue an Order dissolving the</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Federal Government of the United States of America as a legal and political</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">entity. Finally, I ask this Tribunal to declare that international legal</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">sovereignty over the Territories principally inhabited by the Native</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">American Peoples, the New Afrikan People, the Mexicano People, and the</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">People of Puerto Rico resides in the hands of these respective Peoples</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Themselves.</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif"> </span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">In this regard, I should point out that the final Decision of this Tribunal</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">will qualify as a judicial decision within the meaning of article 38(1)(d)</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">of the Statute of the International Court of Justice and will therefore</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">constitute a subsidiary means for the determination of rules of law for</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">international law and practice. The Statute of the International Court of</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Justice is an integral part of the United Nations Charter under article 92</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">thereof. Thus, this Tribunal's Decision can be relied upon by some future</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">International Criminal Court or Tribunal, as well as by any People or State</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">of the World Community that desires to initiate criminal proceedings against</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">named individuals for the commission of the following international crimes.</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">The Decision of this Tribunal shall serve as adequate notice to the</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">appropriate officials in the United States Federal Government that they bear</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">personal criminal responsibility under international law and the domestic</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">legal systems of all Peoples and States in the World Community for designing</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">and implementing these illegal, criminal and reprehensible policies and</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">practices against Indigenous Peoples and Peoples of Color living in North</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">America. Hereinafter, the Federal Government of the United States of America</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">will be referred to as the Defendant.</span><o:p></o:p></p>

<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Cultural Rights, fundamental principles of customary international law, and</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">jus cogens.</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif"> </span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">8. The Defendant has violated the seminal United Nations Declaration on the</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Granting of Independence to Colonial Countries and Territories of 1960 with</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">respect to Native American Peoples and Territories. Pursuant thereto, the</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Defendant has an absolute international legal obligation to decolonize</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">Native American Territories immediately and to transfer all powers it</span><o:p></o:p></p>
<p class="MsoNormal" style="margin-left:1.0in"><span style="font-size:18.0pt;font-family:"Arial Black",sans-serif">currently exercises there to the Native American Peoples.</span><o:p></o:p></p>
