Federal Judge in Boston to Hear Lawsuit Challenging President's Authority to
Invade Iraq without Congressional War Declaration

The U.S. soldiers, parents of U.S. soldiers, and Members of Congress who
filed a lawsuit last week in federal court in Boston challenging President
George W. Bush¹s authority to wage war against Iraq will have their day in
court.  The lawsuit seeks to prevent the President from launching a military
invasion of Iraq, absent a congressional declaration of war.  U.S.
Representatives John Conyers and Dennis Kucinich are leading the Members of
Congress who are serving as plaintiffs.

 ³A war against Iraq without a congressional declaration of war will be
illegal and unconstitutional,² says John Bonifaz, the plaintiffs¹ lead
attorney.  ³It is time for the courts to intervene.²

The plaintiffs filed a motion for a preliminary injunction along with their
complaint.  The motion sought an immediate hearing on their request that the
President be barred from launching a military invasion against Iraq without
a congressional declaration of war.
