Court Rejects the Indefinite Detention of USCitizen
The Second Circuit of Appeals determined today thatthe
President of the United States has no authorityunder
the Constitution to imprison an Americancitizen as an
enemy combatant without any charge.The case dealt with
so-called "dirty bomber" JosePadilla. The issues
addressed in CCR's amicus briefplayed a key role in

Department of Justice Further Criticized by Officeof
Inspector General The Office of the Inspector General
issued a highlycritical report today on the treatment
of detaineesat the Metropolitan Detention Center in
New YorkCity. The detainees in question were Arab and
Muslimmen incarcerated immediately in the wake of
9/11.The report documents a long history of
abuseincluding beatings. To this date, none of
thesepeople have been charged with crimes related
toterrorism. The report confirms many of
theallegations made in CCRâ#8364;#8482;s lawsuit
Turkmen v.Ashcroft. The report also states that many
ofconversations between the detainees and theirlawyers
(including CCR) were illegally videotapedand recorded.
Senior Attorney Nancy Chang: "All Americans shouldbe
grateful to the Inspector General for histenacity in
uncovering evidence that had previouslybeen withheld
from him concerning the horrifictreatment of Muslim
and Arab detainees by MDC prisonofficials following
September 11. These detaineeswere targeted based on
their religion and ethnicityalone, and the emotionally
charged atmospherefollowing the tragedy of September
11 cannot serveas an excuse for this brutality." To
