Subject: SNYT Book Review on Richard Posner

Posner advocates torture. As I tell my students, any law professor, lawyer or judge who advocates torture is sick and demented. Ditto for Posner Jr. The best refutation of Posner Sr. for Torture is by my friend Mike Tigar, whom I consider to be the Clarence Darrow of my Generation. Fab, ABA Member since 1977.
Thinking About Terrorism (American Bar Association) by Michael E. Tigar
One of this country's top litigators directs his laser intellect upon the attack against the United States Constitution, the Bill of Rights, international law, and human rights that is currently being waged in the name of fighting the evanescent "global war on terrorism" in post-9/11 America. Mike Tigar's compelling book is required reading for all of us ABA members, and should be distributed free of charge to every member of the U.S. Federal Judiciary as well as to our opposite numbers in the Federalist Society. With his inimitable combination of erudition, incisiveness, and wit, the author conclusively demonstrates that terrorism can only and must be combated effectively within the constitutional framework established by our Founders, our Framers, and their Successors, including international law and human rights treaties. To do otherwise seriously jeopardizes the very existence of the world's oldest-living constitutional democracy with its seminal commitment to the Rule of Law. Tigar's book is a clarion call for the future of our Republic.
Professor Francis A. Boyle is author of the Biological Weapons Anti-Terrorism Act of 1989, 18 U.S.C. ยงยง175-78 (2007), and Biowarfare and Terrorism (2005).
