allow for racial profiling.

Subject: 12-05-01 -- URGENT ACLU Action Update: Rep. Johnson Crucial to
Keeping Customs Agents Accountable

TO: ACLU Action Network Members in Rep. Johnson's District
FR: Jared Feuer, Internet Organizer
DT: December 5, 2001

As early as tomorrow, the House of Representatives may vote on the "Customs
Border Security Act," a bill that originally addressed wage issues but has
evolved into a measure that would weaken protections against racial
profiling and other illegal searches. In fact, in its current form, the
Customs bill would also undermine the right to privacy in personal
correspondence and move toward making law enforcement agents accountable to
no one but themselves.

Your Member of Congress, Rep. Tim Johnson, has been publicly supportive of
efforts to help end racial profiling. If he opposes the Customs Border
Security Act, other Representatives could very well follow his lead.

If passed, this legislation would open the door to widespread racial
profiling by making it nearly impossible for a person to seek redress for an
unconstitutional search. While Congress is considering bipartisan
legislation to implement President Bush's call to "ban racial profiling,"
this legislation would take a tremendous step back in protecting the basic
freedom of Americans.
