Goal setting is this coming Tuesday and Wednesday. Goal setting time is
important because it serves as the general direction that the City will go

As many of you know the community coalition has been a positive initiative
connecting the community with the Champaign police department and have
walked with many of you during the Walk as One in Garden Hills and other
events.

Over the past few days I have been contacted by some community members
expressing shock that Stig Lannesskog was conducting the presentation on
the Strategic Plan for the Champaign Police Department.

As a refresher, Stig is the former school board President at Unit 4. During
his short tenure as President he oversaw bond transactions that previously
had minority participation but under his tenure he had zero participation.
He handed out approximately $500,000 in no bid contracts with zero
diversity of firms to Champaign Telephone whose owner Mike Hosier, is a
former Champaign City Council member and whose major distinction while on
Council was to be the leading advocate against the establishment of Dr.. ML
King Jr birthday as a holiday.

In addition after the April elections of 2013 when the African American
community had a record turnout, instead of reaching out to the community
and offering support for Jamar Brown as VP of the School Board, Stig
supported his buddy Scott McAdam and tried to defeat Jamar in his efforts.
That whole shenanigan led to the new Board voting Stig out as President and
in less than 45 days he quit the school board.

It is quite appalling and completely disrespectful to the people of
color for this organization and the City to be utilizing Stig within the
police department. This man has been openly hostile to the African American
community, attended no events in our community during his tenure as board
president, practiced exclusion of minorities in contracts, and quit when
his power to reward his good ole buddys like Mr. Hosier with lucrative
no-bid contracts went away.

Now it is necessary for our radar to go completely up. We are asking the
City to provide an accounting as to the process utilized to select Stig in
this capacity, provide information on what his role is formulating the
Champaign Police strategic plan, and what steps the City's plan is to
remove him from the dialogue with the African American community vis a vis
the Champaign Police Department.

This man quit on our kids, he shut out our opportunities, and he associated
and gave business to one of the most racist individuals to ever serve on
the City Council.

Quite simply we refuse to work with him. I have talked to enough leaders as
well as know many of their hearts to know that we will never do business
with this man.

I know he is a close associate of Deb Feinen's and she served as his
attorney in his disputed election the first time he ran. So is the City
turning into one big revolving door to hire buddies of the right wing
faction of the City Council ?

This will not go away. I suggest a meeting with NAACP head Patricia Avery,
a minister from the Clergy, and a member of the North end Breakfast Club
and the appropriate City Officials to answer these questions about Stig's
involvement in the Champaign Police Department and how he was selected to
play that role prior to the presentation being made.

We will not deal with people who quit on our kids, does business with
former elected officials who lobbied, advocated and voted against the ML
King Holiday , and has a track record equal to F in our community when he
served as Champaign Schools Board President.

His involvement changes the whole tone and trust of the Community Walk As
One and the gains we have made at the Champaign Police Department. and
community relations and for that I am deeply disappointed and personally
hurt because of all of the good work that has been done to date.

We look forward to the response from the City of Champaign

Subject: Re: Community Alert ! Black Dog restaurant scheduled to receive
tax rebates

 To the Council members and Staff,

I just read in the News Gazette about a Black Dog restaurant
contemplating opening in downtown Champaign and it quoted TJ Blakeman as
saying a food and beverage tax and sales tax rebate are being contemplated.

While we can appreciate Black Dog opening in downtown Champaign to utilize
these taxes would be a gross negligence of duty to approve. The restaurant
will not generate significant new customer traffic and instead would be
pulling customers from existing businesses that are paying the F&B and
Sales tax. So the net result will be a decrease in overall F&B and Sales
tax receipts to the City.

What is even more appalling is that it is my understanding Mayor Gerard is
championing this cause to exempt this restaurant from their taxes and yet
he was the leading advocate to not exempt the churches from the storm
water tax. Seems to be it is Mayor Gerard's  policy to help white business
owners while ignoring the needs of the black churches and business owners.

Pickens Chicken just opened a restaurant on north 4th street. Did TJ
Blakeman contact them about getting a F&B tax rebate ? Did Mayor Gerard
champion them for city assistance ?   Of course not. In fact of all the tax
rebates considered and approved since Mayor Gerard took office not one has
gone to an African American entity or neighborhood.

And all you " Conservative Republicans "  on the Council , Bruno, Feinen,
McIntosh, do you believe in limited government except when your buddies
like Alan Nudo a known Republican operative, is seeking government rebates
on taxes ?

To the community I want to demonstrate to you very clearly Mayor Gerard
does not fight for our community on important issues like exempting our
churches on the stormwater taxes but will fight for his buddies like Carlos
Nieto, the owners of Black Dog and Doug Larson to receive tax rebates/city
services that are not available to the community.

I urge the members of Council who are independent in their thinking and
rational as to the loss of revenue to the City when revenue is precious to
reject this request from Black Dog Restaurant. Any attempt by staff to
characterize such a rebate to Black Dog as revenue neutral is not correct
and a blatant distortion of the facts.

 Community Members,

If you have a chance watch last Tuesday's City Council meeting on tape
please do so. . One thing I observed while I was there is that the Council
members were writing notes to each other as opposed to discussing the
issues in the public forum.

I immediately submitted a Freedom of Information request of those notes
written to each other. I have attached the denial letter and as usual there
is a distortion of facts as the letter says they were writing notes to
themselves but it was actually to each other.

More significant is this is another clear example of the City led by Mayor
Gerard will do anything to operate in secret, withhold information from
FOIA requests, disseminate misinformation about what is going on, and deny
the people of their rights in accordance with FOIA laws.

The City just lost a lawsuit on this issue to the News Gazette  but it has
not deterred them from acting like a secret organization exempt from the
laws of our State. I have appealed this decision to the Attorney General.
But like last time even if the AG sides against them they will go to court
to protect their secret shenanigans rather than be open and truthful to the
people of our City.

Quite pitiful and sad state of affairs.

It is such a pleasure to spend time working in this southern metropolis
that embraces diversity at all levels of government, business, and
neighborhood engagement.

I had a chance to review the email sent by Mike Smeltzer and it is best to
allow Power Up respond to the technical portions of the email.

Mike I am sure you and your parents are good people and I appreciate all
that you did to help the cause of black people in the 60's and 70's. What I
have observed in the period since 2009 when you picked back up your service
to the community by writing a grant to include the low income people of
Champaign for a program that was geared to that exact community is this :

2011 - Champaign had a Mayor that denied the legitimacy of the
first African American President. Former Mayor Schweighart presided over a
rogue group of officers within the police department that brutalized the
black community and in his tenure he allowed virtually zero participation
by companies owned by people of color with the City of Champaign. In the
April of 2011 election I saw you nowhere fighting for, assisting, or even
speaking out in the cause to unseat this three term Mayor which did happen
with an overwhelming black voter turnout that proved to be the margin of
victory. Where were you then Mike ? Comfortable at the U of I working with
the City to promote in our neighborhoods and churches how many jobs UC2B
 would bring to the AA community.

In fact Mike contrary to the benevolent tone of your email the first phase
of UC2B procurement resulted in I believe one African American worker at
Western and $1,000 for some ribs at a reception were the total black
persons involvement in that first phase. It was only after a strong outcry
from the black community and direction from City Manager Steve Carter did
you and the
 UC2B team revise its process to be more inclusive which had the desired
result.

Now your assertions that Power Up was in way over its head and that you,
Paul Duke, UC2B, Western knew exactly what you were doing is a perfect
example of the arrogance that surrounds this project. I choose to focus on
one factual incident where someone on the UC2B team ordered the wrong part,
but said that the vendor shipped the wrong part, and the email I
distributed where Paul Duke is blaming Power Up for the mistake. I have
challenged the City to produce the evidence that the UC2B team ordered the
correct part and to date  no evidence is forethecoming. There is no
evidence UC2B notified Power Up of what part they ordered. Only
documentation from the shipping company and they say Shive Hatterly ordered
the wrong part. But the tone of their email was to blame Power Up and
accept no responsibility on their part. If that is the type of mentoring
that was being offered, no thank you.

Western was behind schedule in the first phase and in fact the second phase
was delayed because of the lateness by Western in completing the first
phase of UC2B. In fact lets take a closer look at this company Western.
Quite the political firm that's for sure. According to the Illinois
elections Board Western and their CEO  have contributed $70,000 towards
election campaigns all across the State of Illinois. Interestingly enough,
for a project in north Champaign they put their local office in Tolono,
unlike Power Up whose office is in central Champaign. The City of Tolono is
a client of attorney Jim Green who just keeps popping up coincidently all
over this project. Yep Western's office is in Tolono, a place where people
of color can really get there easily to apply for jobs there huh?

As for you being invited into a political retaliation plan, uh no you are
no where near that level of what these people are capable of.

I assume you know Results Plus was involved in the Schweighart campaign and
that both Gordy Hulten and Deb Feinen are Jerry proteges from their days on
the City Council together. To get a better understanding of their
tactics why don't you research Results Plus involvement in the recent
ballot controversy involving Stephanie Holderfield and Rick Winkle. Deb
Feinen was the attorney representing an attempt to remove Ms. Holderfield
from the ballot, Gordy sat on the hearing board, and on or about the day of
the hearing Rick Winkle a party to this case made a $3,000 payment to
Results Plus ( Gordy's political consulting firm where Deb is the attorney
of record) for services and supplies. Eventually Mr Winkle withdrew, Gordy
left Winkle's name on the ballot when he could have removed it, Winkle won
and then was replaced by someone more to Gordy and Deb's liking.That's how
they roll.
 You were not at Douglass Center on April 9th where campaign workers asked
why Gordy was acting so mad when he had to bring more ballots to the
polling place there because they ran out of ballots when our
community turnout was way beyond his expectations which he knew mean't the
demise of his candidates which it did. You did not see the anger in his
face from that turnout effort. I did.

 I do have to say Mike, for all your efforts in the 60's and 70's we really
haven't seen you on the front lines or any line for that matter, fighting
for the justice that has been virtually invisible to the black people of
Champaign in this decade.

What I do find interesting, is that you never described a meeting as called
for in the change order where you and your benevolent friends Paul Duke and
Teri Legner sat down with Power Up, outlined these concerns and attempt to
reach a solution either with or without Power Up involved going forward. In
fact Power Up knew nothing of this new change order until the Monday before
it was to be considered as they were driving to Champaign to try and get
paid their remainng funds. The process to replace Power Up was a
cladenstine series of events that included no discussion with
Councilman Will Kyles whose District this project is in which is a total
lack of respect to him amd his constituents.Councilperson Deb
Feinen encouraged an actual decision to knowingly violate the terms of the
change order by not requiring UC2B to have the meeting with Power Up as
called for in their agreement. In addition she made attempts to convince
the council members to not speak to anyone on this matter due to litigation
that may arise from that decision. These are the types of actions
surrounding this process yet you want us to believe the UC2B was so perfect
and Power Up just wasn't up to snuff.. If its so up and up why all the
secrecy and quiet discussions and strategies and negotiations of a fait
accompli contract of 3 times the previous cost, with a politically
connected contractor, advocated by the most partisan politically
connected/active Republican  member of the City Council ? Probably a
coincidence right ?

As I said I will let Power Up answer the technical questions from their
perspective.

As an update on this situation, The agenda for Monday is a special meeting
to approve the Council Bill to replace Power Up with Western.  Please note
that Power Up received a communication from Councilmember Feinen forwarding
them the previous email I sent explaining that Jim Green was there for a
class assignment. She did not address a single issue in this email. One of
the reasons she did not address any issues is she has been saying from day
1 she cannot talk about this because "there may be litigation". The reason
she is so cautious on the litigation front is that Councilmember Feinen
knows she is asking the City Council to violate the Power Up contract. As
point 1 in the Power Up agreement states   " a. This is a violation of
Change Order #5 which contains the clause that the “Parties will meet to
discuss the extension of time of the agreement to deal with installs turned
over to Power Up to be accomplished after January 31, 2013….”  It says
"will meet".   That meeting never occurred.

I will bring you more updates. If you are able please watch on TV or come
to the meeting to see how they justify violating the agreement with the
first African American prime contractor of the City of Champaign. I am not
asking you to speak unless you want too, your eyeballs watching is all we
need.

No matter how it turns out, know that Deb Feinen is an enemy to our
community. She is contemplating a run for Mayor and if she is successful we
can expect a new era of Jerry Schweighart like tactics to opress the
African American communtiy just like we see happening now. I urge all of
you, do not invite her to your events, do not encourage her involvment in
our community,(not that she does much anyway but with a Mayors race ahead
she will seek more invites) and understand I will be presenting more data
and information on her efforts to supress our community.

Why would she do that ? In the last election our community was over 11.5%
of the Citywide vote a record. Champaign Precinct 1 at Douglass Center was
5% of the total itself another record. Those turnout levels occured after
many success were fought for and won at the City level. Those trunout
levels are a specific threat to the County Clerk Gordy Hullten's Results
Plus political consulting firm which does all of its business with
Republican candidates. In the last two years since Gordy Hulten has taken
office Results Plus has recieved according to the Illinois Election
Commission approximately $175,000 in fees for services. Prior to becoming
clerk that number was approximately $40,000. Again this is about money
and power.  If through our turnout efforts we continue to defeat candidates
supported by Mr Hulten and his allies like Deb Feinen who is the attorney
of record for Results Plus, then we are bad for their business.

Have no doubt the replacement of Power Up by Western is
political retribution by Deb Feinen on behalf of her political benefactor
Gordy Hulten in a long term strategy to slow the progress of our
community's ever growing voter turnout.

Whatever the results of next Tuesday are we will not be deterred  we as a
community are already laying the groundwork for a black voter turnout of
epic proportions in the November 2014 and April 2015 elections. We have
eliminated some of the Schweighart cronies but others remain and they
continue to seek to oppress our community. We will see them in
future election cycles and answer their actions of suppression with
our vote.

          Ladies and Gentleman of the African American community of
Champaign Urbana,

I am writing to you because we have reached a  critical point in our
efforts to have fair inclusion policies and implementation at the City of
Champaign. I first want to disclose I provide consulting services to Power
Up in connection with their efforts in the Central Illinois area. I
recruited Power Up, an African American owned firm based out of St. Louis
because of their strong technical capabilities, $5 million in bonding
capacity, and a willingness to work and mentor local smaller minority
companies and tradesman. They won the bid on phase 2 of the UC2B project
last year and have been working on their contract with local subcontractors
Henry Bell and Peter Folk.

Last night the City Council introduced a council bill led by Deb Feinen and
staff member Teri Legner to replace Power Up with a white owned firm
Western. Below is an email from the President of Power up detailing all of
the things the staff and their project manager have not been factual about
in their communications with Council. Three key factors stand out :

1. The City never attempted to have a meeting with Power Up to discuss the
remaining homes to be wired and the terms and conditions of that wiring as
outlined in the Change order described in point #1 in the Power Up email.

2. The City allowed their project manager to berate, curse out and create a
hostile work atmosphere with the Power Up employees. This project manager
has never worked with a minority prime contractor, was from Bloomington,
and was rude, condecending and downright nasty in emails and in person.

3. Power Up completed approximately 1,000 installations at a 91% customer
satisfaction rate for $1.4 million. The City has negotiated a no bid change
order with Western for the remaining 450 homes for $1.6 million. These
homes were part of Power Up's original bid of up to 1,700 sites but because
the City was slow to sign up customers they only had 1,000 sites by the end
of the original deadline. Now they get an extension and more money and they
want to sweetheart deal it for their friends at Western. More on that
later.

I encourage all of you to go the City's website and watch the tape of last
night's meeting. I spoke on the facts that were misrepresented by the staff
to the Council and introduced the concept that while the majority of the
Council may be for the policy of inclusion, specific staff members may
harbor a culture of racial bias which plays out in the implementation of
this policy. Council member Deb Feinen launched into a tirade calling
out the Power Up subcontractors, reading the customer complaints out loud
and in her own words said " we are getting one complaint per week" . Well
that comes out to 52 complaints per year which on 1,000 installs is a 95%
satisfaction rate but as we all know its how you phrase words that carry
the real meaning. Wetsern the white company had customer complaints as
well. Did Deb Feinen read those out loud? Of course not. Not once did she
address the facts as I presented them to Council.  Her heart and real
feelings about minority particiapation came out in this tirade and reminded
me of Jerry Schweighart when he was railing on our young people saying they
deserved the harsh treatment from the Police. The only difference this time
is it was about contracts and money for our community, same tactics, same
power structure just a diffferent frontier.

As our Pastors would say in church, Now watch this!  :

Deb Feinen is closely linked to County Clerk Gordy Hulten who orchestrated
the Gina Jackson run against Will ( his picture was on her literature)
  and is a strong supporter of Pam Boroski the Township Supervisor. Both
were defeated on April 9th due to another large turnout of African American
voters, both were backed by Gordy Hulten. Deb Feinen is the attorney for
Gordy Hulten's political consulting firm Results Plus, and the local GOP
and by May 7th she s leading the charge to replace Power Up. Coincidence ?
I think not.
Also, last night in attendance of the meeting was an attorney Jim Green who
used to sit on the City Council, is a Republican politically connected
attorney, and he sat in the whole meeting until the Western Contract issue
was posponed and then he left. A politicaly connected attorney does not sit
in a council meeting for free. Is he getting paid by Western for this no
bid contract or was it just a coincidence and he came to watch as a civi
lesson for his daughter? I am betting on getting paid

Money and Power, thats why Power Up is being replaced. The jobs, resources
and other intangibles Power Up brought to our community played a role in
our ability to achieve another record voter turnout in the African American
community and defeat more Republicans all over the City. The $1.6 million
that was available for the extension was more than Deb Feinen and her Jerry
Schweighart cronies could stomach a black firm receiving so
they orchestrated this firing of Pwer Up for their buddies at Western. And
because Teri Legner the staff person assigned to UC2B was never in favor of
this inclusion plan she joined right in and assisted in this high tech
lynching of a black owned firm.

The good news is that 5 members of the City Council voted to postpone
the final decision on this matter until next week. In that time more
information, data and hopefully Councilmembers  with good conscience and
fairness will see that allowing Power Up to finish the project, and yes we
can call it a second chance. Power Up has a 91% customer approval rating,
no data has been presented to dispute that, they went the extra mile to
work with and mentor our local contractors, they hired people from the
community and invested in our get out the vote effort they completed the
1000 hookups in what was one of the weetest coldest winters we have seen in
a long time. The black community of Champaign needs a highly qualified
bondable company like Power Up in our midst and if they can be pushed out
with strongarm tactics then our local smaller contractors don't have a
chance. They desreve a chance to finish the project and if your read the
email they sent to Council below they will save the City 30% on costs as
compared to the Western proposal.

I will keep you updated as the events unfold. If you are able, please
attend the Council meeting nex week Tuesday to watch how your City Council
representatives vote.

  Dear Council Members,

It has come to our understanding that Power Up has endured a very one sided
view point of the UC2B phase 2 project.  In an effort to reflect a 2 sided
story and attempt to control the narrative we have provided the following
factual points before you make your vote tomorrow on the UC2B phase 2.5
project.  We believe the price is absorbent and if given the opportunity we
will prepare a proposal that you will receive that will give you an option
to work with Power Up for significant savings and no loss of quality.
 Despite what you may believe, that you have to rush this proposal through,
to make the schedule for 450 installs right away to make a September close
out.  I will tell you that if we receive all of the scheduled customers
from the start we can make all of these installs within 45 days with
breathing room.


1.       Power Up Electrical was never consulted by the City or UC2B to
discuss extending our Contract to account for new subscribers in the event
that the Federal Grant was extended.
a.       This is a violation of Change Order #5 which contains the clause
that the “Parties will meet to discuss the extension of time of the
agreement to deal with installs turned over to Power Up to be accomplished
after January 31, 2013….”
b.      If one would argue that this does not say future installs, then
they can’t have it both ways as the report attached to the proposed Board
Bill and the accompanied documentation states that there are 450 installs
that “Power Up was not able to commit to completion of the these late
subscriptions….”  This is a direct quote from the Board Bill.  This is NOT
TRUE.  The fact is that Power Up was never asked or even attempted to be
negotiated with in spite of Power Up’s 91.4% customer approval rating.  Not
only does Power Up stand fully prepared to make a firm commitment to
accomplish these installs but at a firm cost of 30% less than Western’s
proposal using Power Up’s own crews and subcontractors approved by the
City.
2.       Power Up’s contract extension had nothing to do with Power Up’s
performance and had everything to do with the failure to sign up
subscribers.  Power Up lost money due to the lack of installs because the
proposal was based on nearly 2,700 installs anticipated.
3.       How does the City justify paying Western $1,875 per residential
install when Power Up was doing it for $310 per install?  Why was Power Up
not consulted as noted above particularly given the HUGE difference in
pricing between Western and Power Up?  Power Up could quadruple its price
and still be 30% less than Western.
4.       How does the City justify paying $20,000 per anchor site install
(times 30 each by the way) when Power Up was doing it for less than $2,500
per. ??
5.       How does the City justify paying Western $45/hour for
administrative time entering information into Sales Force in addition to
Western’s exorbitant unit pricing?  Power Up was not allowed to charge the
City any additional cost for developing its own CRM System when the
City/UC2B had no process or system in place until November 2012?  Keep in
mind, Power Up was issued a Notice to Proceed in June and never had its
first customers until late August.  Once the City/UC2B Sales Force system
was finally put in place, Power Up went through the extra effort of moving
all of the previous data into the new system and then used Sales Force for
all remaining installs.  Not only did Power Up complete all of this double
entry and extra work, the City had the gall to hold up Power Up pay
requests until this work was complete!
a.       As much as the City wanted Power Up to terminate Volo’s contract,
we explained that because the City had no CRM system, all of the project
data was within the Volo system that we developed and that we needed to
carefully manage this to insure that the data was transferred.  Terminating
Volo would have been a total disaster.  We managed through any and all of
these issues, protecting the City and UC2B, while completing all of the
work and still achieving a 91.4% customer approval rating.
b.      Had Power Up terminated Volo and Southern Belle, it would have been
a political and technical disaster.  All because Power Up attempted to
mentor a local firm and because the City/UC2B had no customer management
system in place.
6.       How does the City justify paying $100 per reschedule to Western in
addition to their exorbitant unit prices?  Power Up received no
compensation for its large amount of rescheduling customers at no fault of
Power Up.
7.       How does the City justify paying $290 per customer “no shows” in
addition to Western’s exorbitant unit prices?  Power Up received no
compensation for its large amount of “no shows”.
8.       How does the City justify paying $1.6 million to Western for 450
residential installs and 30 Anchor installs when Power Up completed just
under 1000 installs for $1.4 million?
9.       Power Up completed its last scheduled install on January 24th and
still has never received Final Payment.  Power Up has never received a
Punch List as called for in the contract.
10.   Power Up has, without delay, responded immediately to any and all
service calls received since the last install.  Even the engineering
directives issued by Paul Duke like clockwork on Friday afternoons between
3 and 5 pm.   To date, there are ZERO unresolved issues or open tickets.
(In spite of the fact that Power Up was routinely not paid for 60 to 90
days throughout the course of the project and still awaits payment on its
March 21st invoice.)
11.   Power Up stayed the course even after Mr. Paul Duke called our
Project Manager a blanking blanksucker.  This is documented with
witnesses.  Clearly a reason that certain people likely want to move Power
Up along.
12.   The original RFP anticipated 2,700 installs.  Power Up can only
install what it is released to install.  The final number was just under
1,000.  Power Up suffered significant financial hardship given that its
overhead costs were spread into the unit cost per install as dictated by
the bidding documents.  The 1,700 less installs would be well beyond the
realm of less than reasonably anticipated.  Signing up customers was 100%
the responsibility of the Owner.  Power should be given the opportunity for
equitable adjustment given these extraordinary circumstances at no fault of
Power Up – especially given the fact that the City did not honor Change
Order 5 and give Power Up an opportunity to discuss the future installs.
These future installs are what should have been original Power Up installs
that did not get signed up.  Instead the City wants to hire Western and pay
them 5 to 6 times more at Power Up’s expense???
13.   There is definitely a narrative that has been established regarding
Power Up whereby Power Up has had no opportunity to set the record
straight.  The misinformation and mischaracterizations out there are
alarming and inflammatory to say the least.
14.   There is no justification for paying all of the above.  In as much as
certain people have chosen to smear Power Up, the fact is that Power Up got
the job done, has no outstanding tickets, achieved a 91.4% customer
approval rating, bank-rolled the project, has no claims from
subcontractors, and doubled its warranty.  All of this while the City/UC2B
developed their systems and processes on the fly and failed to sign up more
than 60% of the originally intended subscribers.  Who failed?

Attached is the copy of the Change Order #5.  Section 3 at the bottom says,
“IF the underlying Federal grant is extended beyond January 31, 2013, the
Parties will meet to discuss the extension of time of the agreement to deal
with installs turned over to Power Up to be accomplished after January 31,
2013 upon substantially the same terms and conditions.”

No one from Power Up was ever contacted to do what the Change Order clearly
states that the Parties WILL meet to discuss.  Instead, the city has chosen
to negotiate a deal with Western and pay them multiples over Power Up’s
pricing plus additional sums for multiple administrative costs.  This was a
term and condition of the Change Order that is part and parcel to our
overall agreement of the change.  This is not dealing in good faith and the
people are paying double – triple – quadruple or more??  Not to even
mention all that we discussed today in our meeting together where all of
the protocols that we developed are now incorporated into the proposed
change order to Western.

Fred, you and I specifically negotiated that clause and I have notes and
emails that support it.  The statement in the Board Bill report is
factually false that Power Up could not commit.  We were never asked.  All
we were charged to accomplish was the highest number of installs possible
by January 31st as this Change Order clearly states.
