<font size=+1>First Amendment Case Headed To Federal Court in Illinois</font>
<br><br>
<i>August 8, 2002</i><br>
This fall Margaret Hosty and Jeni Porche of Illinois' <a
href=http://www.govst.edu/>Governor State University</a> will be
representing themselves
in federal court over what may become a significant First Amendment case.
Officials at
the suburban Chicago campus attempted to <a
href=http://caselaw.lp.findlaw.com/data/constitution/amendment01/09.html>prevent</a>
an
issue of the school paper the
<i>Innovator</i>, of which Hosty and Porche were reporters, from being
published. School
officials, with the backing of Illinois Attorney General <a
href=http://www.naag.org/ag/ag_bios.cfm?state=illinois&wildcard=bios>Jim
Ryan</a>, are
defending their decision based on the 1989 St. Louis based case, <a
href=http://www.ux1.eiu.edu/~cfjat/classes/4101/casebook/Hazelwood.html>Hazelwood
v.
Kuhlmeier</a>. According to that case, school officials can prevent
issues of school
newspapers from going to press under certain circumstances. First
Amendment advocates say
that if the university has its way in this case, it would set a dangerous
precedent for
free press on college campuses.
