[Peace-discuss] the Brian Chesley case

I. Sentencing of Brian Chesley is scheduled for May 9. Until that has
occurred, it would be best for Brian if everyone refrains from commenting on
the JUDGE in the case.

Please feel free to write,e.g. letters to the editor, and speak about any of
the other issues in the case, such as
      the all-white jury and jury pool,
      the charges put on Mr. Chesley, and the manner of placing them by the
States Attorney - adding the Obstruction of Justice on the day of first
pre-trial motions - ten months after the first and only charge (Resisting
Arrest).
      the dubious purpose cited by Officer Davis for stopping Brian in the
first place, i.e. getting information on individuals in a neighborhood and
entering them in a database
      misuse of the "Terry Stop" in which a police officer may stop a person
on a reasonable suspicion of a crime ABOUT TO BE committed. The "crime"
cited on the stand by Davis was "trespassing" as Brian was EXITING the park
on to the sidewalk. Had there been a violation of trespassing, then that
could have been a reason for arrest and filed charges of trespassing. The
word "trespassing" did not even appear in the police reports.
      the brutality of the police "response"
      any other issues you have on your mind, not related to the judge.

II.
Anyone who was not admitted entry to the court proceedings should report the
time and day that they were not allowed in - to the Kirchner law office,
355-5660.


III. Anyone wishing to contribute to the money necessary to filing an
appeal, please make out a check to CUCPJ and get it to someone in the group,
which meets at 4:00 on Saturday at the IMC, or mail it to the Independent
Media Center. These funds are being collected in April.
