I tho't Stuart's post was right on target, i e objections to Chgo blues club's giving "murder music" a forum... another example of attempt to deny a commercial platform vs governmental banning. (Of course, gov't continues to have legal right/responsibility to ban speech that incites to violence, if/when that has been proven to be the case).

How puzzling.  The issue was not making it a CRIME.  Why confuse matters further 
by injecting  this red herring?
